In the event of any conflict between these Terms & Conditions and a signed service agreement, the service agreement shall prevail.

6. Fees and Payment

Statutory value-added tax is charged in addition where applicable. Late payments may incur interest in accordance with Section 288 of the German Civil Code (BGB).

7. Client Responsibilities

To enable KapitalBalance to deliver its services effectively, clients agree to provide accurate, complete, and timely information, including financial statements, budgets, and spending records as reasonably requested. KapitalBalance is not liable for deficiencies in its work that result from inaccurate, incomplete, or delayed information provided by the client.

8. Limitation of Liability

KapitalBalance provides its services with the care and diligence of a professional consultancy. To the maximum extent permitted by law, KapitalBalance shall not be liable for indirect, incidental, or consequential damages, including loss of profit, loss of business, or loss of data arising from the use of this website or our services. Nothing in these Terms & Conditions excludes or limits liability for intent, gross negligence, personal injury, or other liability that cannot be excluded under German law.

9. Confidentiality and Data Protection

Both parties shall keep confidential all non-public information obtained in the course of an engagement and shall not disclose it to third parties without prior written consent, except where required by law. KapitalBalance processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). 10. Right of Withdrawal for Consumers

If you engage our services as a consumer within the meaning of Section 13 BGB, you may have a statutory right of withdrawal under German consumer protection law, provided the agreement was concluded by distance means. Where you request that services begin before the end of the withdrawal period, you acknowledge that upon full performance of the services you lose the right of withdrawal and must pay the agreed remuneration.

11. Term and Termination

Service engagements continue for the period stated in the service agreement. Either party may terminate an ongoing advisory engagement with four weeks' written notice to the end of a calendar month, unless otherwise agreed. Upon termination, fees for services rendered up to the termination date remain payable.

These Terms & Conditions and any disputes arising from them are governed by the laws of the Federal Republic of Germany. The place of jurisdiction, insofar as legally permissible, is Hamburg, Germany. Mandatory consumer protection provisions remain unaffected.

15. Severability

Should any provision of these Terms & Conditions be found invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects its economic intent.
